So what are the changes to the new Asbestos LEGISLATION guidelines? - HSG 264 the asbestos surveyors guide.


The control of asbestos regulations 2006 (CAR 2006 Regulation 4) affects persons, companies and organisations that have a clear responsibility (called the duty) for the maintenance, repair and/or up-keep of non-domestic properties & premises.
What has changed recently with asbestos regulations?
In 2006 the Government introduced new regulations that were to be followed in relation to the control of asbestos in the workplace. In the new regulations, guidelines for asbestos surveyors & duty holders (HSG 264) of commercial premises were laid down. The biggest change came with the rebranding of Type 1, 2 & 3 asbestos surveys. Although the actual surveying methods have remained the same, the way in which asbestos surveyors inspect the properties has changed slightly.


Now: Old Type 1, 2 & 3 surveys have been rebranded as:

• ASBESTOS MANAGEMENT SURVEYs = Older style Type 1 & 2 surveys


These surveys are required for the day to day management of commercial premises. These surveys will assist the duty holder to comply with their Health & Safety at Work obligations.

Having a management survey carried out of the premises does NOT constitute full compliance with your asbestos or any other Health & Safety obligations. A management survey should be used as part of an ongoing management plan to minimise (or reduce completely) the risk of exposure to employees, staff, contractors, public etc. A good asbestos management plan will continually monitor, assess the risk & take suitable actions where ACM’s are concerned.

A management survey usually involves minor intrusive work such as removing ceiling tiles, accessing behind wall panels and will usually require the surveyor to take samples of suspect material which can then be analysed at our laboratories.

The new Health & Safety Guide - HSG 264 guidelines state that it is no longer acceptable to conduct simplistic visual surveys of premises and that asbestos surveyors should deploy a thorough, deep & intrusive (if necessary) scan of the building, by taking any means necessary to access all areas of that building in their pursuit to locate ACM’s

• ASBESTOS PRE-REFURBISMENT / PRE-DEMOLITION SURVEY = Older style Type 3 surveys


These surveys are required where a building (or part of it) is to be refurbished or demolished and where the fabric of the building is to be disturbed. These types of surveys will be fully intrusive and involve destructive inspection, where necessary, to gain access behind walls, under floors, ceiling cavities etc (this list is not exhaustive)

Again, The new Health & Safety Guide - HSG 264 guidelines state that it is no longer acceptable to conduct simplistic surveys of premises and when conducting refurbishment / demolition surveys asbestos surveyors should take any means necessary to gain access to all areas of the building where the refurbishment / demolition work is to take place.

An asbestos survey of a building that is to be refurbished / demolished may consist of both a management survey & and a refurbishment/demolition survey.
These changes were introduced in 2006 and although the Health & Safety Executive have allowed asbestos surveyors and duty-holders alike a certain amount of grace period for the new changes to be filtered into operation, earlier this year it became mandatory for duty holders & asbestos surveyors to follow the new guidelines set down in HSG 264 – Asbestos: The survey guide.

Any non-compliance of the guidelines can find surveyor/duty-holder in breach of regulations!

Health & Safety issues relating to your survey


The HSE have recently (Jan 2010) specified strict guidelines for the carrying out of asbestos surveys. It is no longer acceptable to simply give a visual impressions of the building and to conclude findings from the visual scan.

This means that asbestos surveyors have to access ALL areas that were previously inaccessible such as roof spaces, riser ducts, floor spaces etc. This can provide the surveyor with a number of Health & Safety issues to overcome before the actual survey takes place. Temporary scaffolding may need erecting prior to a roof tile sample being taken (Under Working at Height Regulations) for instance or air monitoring carried out prior to entering a confined space area such as a lift shaft (Working in Confined Spaces Regulations).


As part of our proposal and if required, we will specify any Health & Safety issues that will need to be addressed prior to the site survey.

Please bear in mind that the Health & Safety Executives now expect full co-operation from the duty holder to provide the surveyor with any access arrangements or Health & Safety requirements necessary.


If any issues arise either before or during the survey that may hamper the surveyors job in locating & identifying ACM’s, then this would need to be logged in our report. Under HSG 264 guidelines these areas, called CAVEATS are to be strictly limited!


Due to widespread abuse of the old regulations where caveats where used extensively by some surveyors of a way of simply skimming over properties, therefore conducting inadequate asbestos registers. The HSE will now hold to account any surveyors / duty holders who are not taking EVERY reasonable step to ensure they know where the asbestos (if any) is on the premises.
